Many people don’t realize that having a pending immigration case doesn’t automatically disqualify you from getting a Texas Driver’s License. According to the Texas Department of Public Safety (DPS), certain applicants with pending cases may still be eligible.

Who Qualifies?
You may be eligible to apply for a Texas Driver’s License if you have a pending:
- Extension of status application
- Change of status application
- Petition for nonimmigrant worker
- I-918 application
- Other pending category
What Documents Do You Need to Bring?
You will need to bring an immigration document that includes your alien number or your I-94 number.
If your immigration document with your alien number or your I-94 has expired, you may still be able to use it — as long as you also bring supporting documentation showing your case is pending.
What If My Documents Are Expired?
Don’t worry if your documents have expired. You may be able to present a Form I-797 that shows a pending application for any of the following:
- Extension of status
- Change of status
- Petition for nonimmigrant worker
- Other pending category
Important Note
If you present documentation other than what is listed above, it may require additional review and approval from Texas DPS. It’s always a good idea to bring as much supporting documentation as possible and to call your local DPS office ahead of your visit to confirm what they will accept.
